The Director of the ONDCP, Lt. Col. Edward Croft, is pleased with the recent successful conclusion of the Country’s first confiscation case under the Proceeds of Crime Act and wishes to congratulate the men and women of the ONDCP who worked tirelessly during this landmark case.

The ONDCP first arrested Luke Joseph of Tortola along with Lloyd Frett in February of 2011 with over 160kilos of cocaine aboard a sailing vessel. This was a joint operation with the ABDF Coast Guard. During the investigations, it was realized that Joseph profited from the illicit trade which was evident from the stockpile of US $30,000 cash found in his home and the very house in which he resided in the British Virgin Islands.

After careful consideration of the arguments put forward by the DPP and the Defendant’s Attorney, the Judge ruled in favor of the prosecution and Luke Joseph was ordered to pay EC $ 80,646.00 to the state. Failure to pay would result in another five years imprisonment. The Court determined from the evidence presented, that Joseph possessed realizable assets (Cash and House), that could be used to settle the Confiscation order.

The Presiding Judge, Justice Keith Thom applauded the ONDCP for its role in the investigation and successful conviction, and Director Edward Croft extended appreciation to the DPP for his successful prosecution in this case.
